These terms govern your use of this website and services, operated by Alan MacDougall, trading as MacDougall Email. By using the site you accept them.
Use of the Site
The site provides information about services, free tools, and subscription offerings including The Brief newsletter and DMarcus Lite. Content is provided for general information only and does not constitute professional advice. An enquiry via the contact form does not create a client relationship; one is formed only when we agree scope, price and terms directly.
Free Tools
The authentication checker, DMARC report viewer, SPF generator, preflight checklist, ROI calculator and cost comparison tools are provided free of charge, “as is”, without warranty of any kind. Their results are indicative only and do not constitute an audit, assessment or guarantee of your email deliverability. A domain that passes every check can still have deliverability problems, and a check that finds nothing may simply not have located the relevant records. You use the tools at your own discretion and are encouraged to seek qualified advice before acting on any result.
Subscription Services
The Brief — a weekly newsletter. You may unsubscribe at any time via the link in every email. Unconfirmed signups are deleted after 7 days.
DMarcus Lite — free DMARC monitoring for one domain. Weekly summary emails report on aggregate reports from mailbox providers. If it stops being useful, unsubscribe from the email — that is the whole cancellation, with your data removed within 30 days. Unverified signups are deleted after 30 days. DMarcus Premium and other managed services are governed by separate engagement terms. Processing of report data under DMarcus Lite is governed by the Data Processing Agreement, which forms part of these terms.
Paid Engagements
Small fixed-price services (e.g., one-off DNS configuration) and commercial engagements (audits, rescues, retainers, managed hosting) are governed by the specific terms agreed in writing for each engagement. Those terms take precedence over anything here.
Intellectual Property
Site content belongs to me or is used with permission. You may view, print and share pages for personal, non-commercial use. Nothing in this site transfers any intellectual property rights to you.
Your Data
Personal data is collected and retained as described in the Privacy Policy. You can request erasure of everything held about you at any time using the delete my data page. For DMarcus report data, processing terms are set out in the Data Processing Agreement.
Limitation of Liability
To the extent permitted by law, I am not liable for indirect or consequential losses arising from use of this website, its free tools, or the free subscription services (including DMarcus Lite). Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
Third-Party Services
The site and services use Cloudflare infrastructure (Workers, D1 databases, KV storage, Email Sending, Email Routing).
Governing Law
These terms are governed by the law of Scotland, and the courts of Scotland have exclusive jurisdiction over any dispute relating to this website.
Changes
I may update these terms; the “Last updated” date changes accordingly. Continued use of the site after a change constitutes acceptance.
